Our client, a rapidly growing national franchise company, is seeking a Privacy Counsel to join its busy team in Atlanta, GA. The Privacy Counsel will provide enterprise-wide advice and counsel on data privacy and data security matters, as well as provide significant support for the development of the company’s privacy program, working across the entire portfolio of brands and coordinating with technology, marketing, cybersecurity, product, and data analytics teams. The ideal candidate will have general knowledge and experience relating to data privacy, vendor risk compliance, and CCPA and GDPR with a focus on supporting technology. Law firm experience as well as in-house experience is preferred. Candidates should be excited to join a fast-paced, growing, highly visible team and eager to touch all aspects of the data privacy offering.
RESPONSIBILITIES
- Support the design, implementation, and maturation of corporate processes, controls, and systems affecting personal data or data governance
- Conduct and review privacy risk assessments and provide privacy guidance to U.S. and international business teams, as well as HR, on the implementation of internal and external processes and tools
- Develop and update privacy policies and notices, procedures, training, guidelines, and cookie notices
- Draft, review, and negotiate privacy-related contract provisions across a wide variety of commercial contracts; review and negotiate data processing agreements
- Manage front-end privacy consumer request processes and ensure internal teams adhere to legal requirements associated with such processes
- Partner with technology, marketing, and HR lawyers to provide appropriate privacy and cybersecurity guidance various business and legal projects
- Develop and maintain effective working relationships with internal teams; manage outside counsel as needed
EDUCATION AND EXPERIENCE QUALIFICATIONS
- Minimum: Graduate Degree
- Juris Doctor degree from an accredited U.S. law school. Licensed and in good standing to practice law in the U.S
- Several years of practice in a law firm or corporation representing public and/or private companies with respect to privacy, cybersecurity, and contractual agreements
REQUIRED KNOWLEDGE, SKILLS or ABILITIES
- Background in privacy, cybersecurity, and contracting, including data processing agreements, SaaS solutions, software/hardware license and purchase agreements, consulting agreements, and SOWs
- Experience supporting the development, implementation and maturation of a company’s global privacy program
- Ability to work independently, make decisions, and exercise independent judgment with respect to highly complex projects, contracts, and transactions, in a fast-paced environment with tight deadlines, while balancing risks with the needs of the business
- Experience with data privacy issues, primarily in the US, but some international experience beneficial
- Ability to work with diverse group of professionals, supporting multiple brands, business units and locations
- Ability to integrate and balance priorities for the benefit of multiple internal clients
- Displays excellent written and verbal communication and facilitation skills
